Brian Kaser and April Streeter each presented at Aging Services of Michigan’s Regulatory Day on December 1, 2010. Brian’s first presentation to the group asked the question “Is Your Compliance Program Up to Date?” He showed how providers see themselves, how the government sees providers, and how an active compliance program bridges the gap between these two views. April followed up that topic with a discussion on Compliance Education. She answered many of the basic questions providers ask about compliance education: who, what, where, when, why and how. Finally, Brian concluded the compliance portion of the day’s discussion by showing providers when it is best to involve legal counsel and consultants in an internal investigation, what the difference between these two professionals is, and how to ensure the provider does not lose its attorney/client privilege once it has been established.

Brian Kaser appeared at the Eli Broad Graduate School of Management, Michigan State University, on October 2, 2010, and presented a course component addressing Legal Issues in Long Term Care Administration. Brian is an adjunct professor of health care law at the MSU College of Law and lectures from time to time at the Broad School.

Chris Garfield and Brian Kaser have made several presentations on the HITECH amendments to the HIPAA privacy law. The presentations, made between March 2010 and July 2010, were to audiences of nursing home, home health, DME and hospice managers. In addition, Brian Kaser made a closed presentation to a client hospital board on the same topic.

Brian Kaser moderated a September, 2008 panel presentation on legal ethics sponsored by the Wisconsin Department of Justice. The Department sponsored the day-long seminar in Madison for its own lawyers and lawyers who staff various Wisconsin administrative and legislative agencies. Approximately 200 lawyers attended. Also appearing on the panel were Nathan Fishbach of Milwaukee’s Whyte, Hirschboeck Dudek law firm and law professor Kathleen Clark of the Washington University in St. Louis. Prof. Clark spoke on the ethics and realities of lawyers as whistleblowers. Mr. Fishbach discussed his distinguished career as an Assistant US Attorney, with emphasis on the ethical issues that those government lawyers confront in their unique and powerful roles. Kaser spoke individually on the legal ethics of internal investigations, a topic he had addressed in 2007 for the American Health Lawyers Association’s Long Term Care and the Law program. The presentation addresses the issues of loyalty, confidentiality and control that arise when a lawyer interacts with corporate staff while investigating the client’s internal activities.
Brian Kaser moderated a March 21, 2008 symposium on privacy and human subject research, co-sponsored by the Journal of Medicine and Law at Michigan State University College of Law and the Michigan State University Human Research Protection Program. The symposium was held at the College of Law in East Lansing, Michigan. Presenters include practicing health care lawyers, bioethicists, microbiologists, research physicians and leaders of institutional review boards. In addition, Mr. Kaser will present an analysis of the decision in Washington University v. Catalona, 490 F.3d 667 (8th Cir. 2007), cert. denied sub nom Ward v. Washington University, 128 S.Ct. 1122, 76 USLW 3226, 76 USLW 3390, 76 USLW 3392 (2008), a case in which ownership and continuing control of biological specimens was contested among a research university, a research scientist and tissue donors.
